1. Use of Products

All Products are created and owned by Company. Each Product has varying use restrictions, depending on the applicable license terms are located in the License Dictionary section, below. When using any Products,  it is your responsibility to ensure that you have permission to use those Products in connection with your desired end use. Please note that use in connection with non-fungible tokens, future existing technologies, and any material that is pornographic, fraudulent, immoral, infringing, illegal, harassing, offensive, or defamatory is prohibited with any license currently offered by Company.

Be sure you understand how you can use Products you purchase.

2. Intellectual Property

Company and/or its licensors is and will remain the sole and exclusive owner of all intellectual property rights in each Product and all content incorporated into each Product, and including, but not limited to source code, object code, graphic designs, files, and all applicable copyright, trademark, and other intellectual property rights. You do not acquire any ownership of any rights in any Products by virtue of purchasing a Product. Any sale, distribution, transfer, copying, or unauthorized use of any Product to a third party for that party’s use is strictly prohibited unless specifically permitted in the license level applicable to your purchase (detailed in the License Dictionary section below) and may result in termination of your account with Company, among other repercussions.

You are prohibited from directly or indirectly selling, licensing, renting, distributing, transferring, reproducing, altering, modifying or attempting to modify, reverse-engineering or creating derivative works from any Products in any way that contradicts this License or the licensing terms applicable to any purchase you make through the Website. Despite the previous sentence, you may make one copy of the Product for archival purposes only, provided you are the only one with control over that file.

Despite the previous term, if you are located in a European Union member country, you may reverse engineer a Product only to the extent you are creating an interoperable software program and the information you require is not available from Company, and only to the extent Company does not provide you with such information within thirty (30) days of your written request for such information.

Your rights to any Products are limited and do not include intellectual property ownership, except for your individual permissions as stated in the License Dictionary. (Much like buying a music album allows you to use it but you do not own the rights to the songs just by purchasing the album.)

3. Transfers

You may not transfer, assign, or lend any Products to any third party unless:

• That party accepts and agrees to be bound by the terms of this License and you destroy your copy and/or copies of the Products being transferred; or

• Such transfer and/or assignment is made to a business entity entirely owned by you and/or in connection with a merger and/or purchase of substantially all of your assets 

You can’t just transfer or give Products to others. This section makes clear the parameters you must follow with transfers.

4. Attribution

You must give the following credit on any websites or webpages on which the Products appear:

If you use any Products on websites, you must credit us. Thank you!

5. Audit

In order to ensure and verify compliance with this License, only upon reasonable notice to you, Company may request specimens and/or other information from you showing your use of any Products and any other information supporting the level at which you have licensed any Products, all of which you will provide to Company free of charge. If any audit reveals a breach of this license and/or an inaccurate representation made by you, then you will remit the amount of the underpayment to Company and reimburse Company for the costs of conducting the audit. These remedies are in addition to, and not instead of, any other legal action Company may choose to take as a result of your breach and/or misrepresentation.

We can request specimens or other info from you at any time to make sure you’re using Products according to this License.
